Click HERE to watch The CrimeLine, where Jon Leiberman and I discuss Jodi Arias’ battle with Juan Martinez in cross examination. There are several tactics behind Martinez’s cross, namely exposing her “litany of lies.” Yet, is his rough demeanor and bulldog-like questioning going to distract jurors and make them sympathize with Arias? Not likely, since she is showing such a smug attitude in response, never providing straight answers and acting as if she is smarter than him. 1. Excellent analysis. Agree completely.

new question: during the final days of his cross-examination, Martinez tells / asks jodi about the issue of the bullet shell casing being on top of the blood on the bathroom tile ( i.e. that Travis was stabbed first, then shot ), then on the last day of his cross-exam ( Thursday 2/ 28 ), Martinez says to her while she is sobbing on the stand, “Would you also agree that you’re the individual who stabbed him in the upper torso?”
    “Yes,” replied Arias.
Martinez asked, “And according to your version of events, you’re doing this to this individual after you have already shot him, right?”
    “Yes,” replied Arias.

Granted, he does state ” according to YOUR version of events “……but, might the day be confused here with which events occurred first, second, third, etc.? Might some members of the jury be confused about stabbing before or after gunshot ?, and if they are might some members possibly be inclined toward having pity / mercy on Jodi. I would have thought that Martinez might get Jodi commited to stabbing first, then gunshot, then further stabbing, the throat wound, but I think he had a ” it does not matter ” attitude since she confessed to ALL three deeds, not neccessarily the correct order of events. But, again, I am little nervous about how the jury will interpert Martinez’s conflicting statements, i.e. gunshot first versus gunshot not first. Might the defense find this as a flaw and try to exploit it for Jodi’s rebuttal and final summations defense. What do you think ? Important or not ? Please share !
